Domestic Violence

If you are a victim of domestic violence, either physical or verbal, it is possible under the Domestic Violence Act of 1996 to seek the protection of the Courts by applying for a Safety Order or Barring Order.

A Safety Order is an Order of the Courts which prohibits the violent person from further violence or threats of violence. It does not require that person to leave the family home. If you do not live with that person it prohibits them from watching or being near your home and thereby intimidating you.

A Barring Order does require the violent person to leave the family home. The Order also prohibits that person from further violence or threats of violence and from watching or being near your home also.

The District Court deals with Safety Orders and Barring Orders.

It is possible to obtain an Interim Protection Order or an Interim Barring Order while waiting for the full matter to be heard. Any interim orders are made on an ex-parte basis.
