Separation Agreement/ Deed of Separation
A Deed of Separation is a legally binding document which deals with all issues that can be dealt with by way of Judicial Separation proceedings with the exception of dealing with your pension. A Deed of Separation, which is also known or referred to as a Separation Agreement, is an agreement negotiated and reached through spouse’s respective Solicitors.
A Separation Agreement is generally not ruled an order of the Court but it is possible to have it ruled if necessary. We believe as a firm that any person separated from a spouse should try and exhaust the possibility of entering into a Deed of Separation amicably especially where children are concerned although we do recognise that this is not always possible in some cases.
It is important for a spouse to note that a Deed of Separation should not be signed without independent legal advice, as it is extremely difficult to overturn the terms of the Deed of Separation down the road should you wish to pursue a Divorce. The Courts are only willing to open up the terms of a Deed of Separation/Separation Agreement when the financial circumstances of the parties have changed considerably.
